1. Privacy Policy and Terms of Use 


1.1 Please refer to Gasoline Alley Services Limited (“g.a.s.”) Privacy Statement (“Privacy  Statement”) for the terms on which we will collect, store and use personal information in  connection with the website. 

1.2 Agreement to the Privacy Statement is a condition of your using the website. By using the  website, you confirm your acceptance of the Privacy Statement. 

1.3 We will send you email marketing to your email address if you agree to us doing so. If you wish  to unsubscribe from any email marketing communications you have previously agreed we can  send you, you can:  

(a) follow the unsubscribe instructions in the email; or  

(b) phone or write to us using the contact details in that email message. 


2. Disclaimer 

2.1 The information we provide on the website is provided to you in good faith. However, it is an  introduction to g.a.s. products and services only. If you purchase g.a.s. products and services  then at the time you place an order with g.a.s. or any g.a.s. retailer, you will be making an offer  to purchase those products and services. We can accept or decline that offer in our discretion.  Separate terms relating to the sale and purchase of g.a.s. products and services will apply. 

2.2 While we will do our best to make sure that the website is available, we cannot guarantee that  it will always be uninterrupted or that your access will be error-free, or that any files available  for download will be error-free or free from viruses, faults or defects. 

2.3 Links or references to other websites are provided for your convenience only. Other websites  are not under our control. We have not reviewed them and we do not endorse or assume  responsibility for the contents of any other website.

The material on this site is subject to copyright except where it is  otherwise noted. You can use the material for your own personal, non-commercial use  provided that you acknowledge the source of the material and that you do not remove any  copyright, trade-mark or other intellectual property notices contained in the content, but you  must not use the material in a misleading way. 

3.2 However, you must not use any of our trade-marks in any other way without our permission.  This includes, but it is not limited to the g.a.s., 100% KIWI and g.a.s. App logos.

4.1 Nothing in these terms affects any rights you may have under the Consumer Guarantees Act  1993. 

4.2 New Zealand law governs this website. 

4.3 Changes or updates to the content of this website may occur at any time. These terms may be  changed or updated from time to time. Changes may take the form of completely new terms.  We will post any changes on this website; any change applies from the date it is posted.


G.A.S PRIVACY STATEMENT

1. Your rights and what you can expect from g.a.s. 

1.1 The statement below applies to personal information (information about an  identifiable individual) Gasoline Alley Services Limited (“g.a.s.”) collects about you. This includes, but is not limited to, when you download and use the g.a.s. Application (“App”) or when you use g.a.s.’ website (“Website”). 

1.2 When you provide g.a.s. with personal information, g.a.s. is obliged to comply with  the provisions of the Privacy Act 2020 (the “Act”) and the General Data Protection  Regulation (“GDPR”), the EU data privacy law. g.a.s. will collect, hold, use, and  disclose that information in accordance with the principles set out in the Act and  GDPR. 

1.3 This means g.a.s. will: 

(a) Use personal information only for the purposes g.a.s. collects it for; 

(b) Retain that information only for so long as necessary to fulfil the purpose for  which g.a.s. has collected it; and 

(c) Disclose or release it to a third party only where g.a.s. is: 

(i) Required to do so by law; or 

(ii) Is permitted by law to do so; or 

(iii) Has been authorised to do so by you; or 

(iv) Doing so for the purpose for which the information was collected or a  directly related purpose. 

1.4 Under the Act, you have the right to access, and to request correction of, any  personal information that g.a.s. holds about you. If you wish to do so or have any  questions relating to these matters, please email us at info@gas.kiwi

1.5 You should be aware that deleting the App from your device, or deactivating,  deregistering or deleting your App account, does not erase the personal  information g.a.s. has collected from you.  

1.6 We will not keep your information for longer than is reasonably necessary to fulfil  the purposes outlined in this statement. If you want to confirm what personal  information of yours g.a.s. holds or request that g.a.s. deletes any of this information,  please contact g.a.s. at the above email address. 

1.7 We may process and store your personal information with third-party contractors.  This may include contractors based overseas. Accordingly, your personal  information may be held outside New Zealand. 

1.8 g.a.s. reserves the rights to modify, amend or vary this Privacy Statement from time  to time. Such modification, amendment or variation will be effective from the time  it is published on the Website and/or App. While we may take additional steps to  bring this to your attention, it is your responsibility to review the current version of  the Privacy Statement.

1.9 If you think g.a.s. has breached the Act or you would like to find out more about  g.a.s.’ obligations, information is available on the Privacy Commissioner’s website at  www.privacy.org.nz


2. The types of information that g.a.s. may collect from you 

2.1 When you use the App or the Website, g.a.s. may collect your personal information.  This includes, but is not limited to, the following: 

(a) Your name, email address, mobile number, and other contact details; and

(b) Identity and biometric information; and 

(c) Age, gender ethnicity, and any other demographic information you provide  us; and 


(d) Loyalty or discount programme information; and 


(e) Credit card and payment information; and 


(f) The details of transactions processed or attempted, including the type of  service requested and the date, time and value of each transaction; and 


(g) Information about the way you use the App and Website, including information about the frequency, habits and preferences of your use; and 


(h) The geographic location of your device when using the App and, if you  authorise it on your device, when the App is running in the background of  your device; and 


(i) Your IP address, and your geographic and other information as may be  determined from your IP address; and 


(j) Information about your device, including the IP address of your device, your service provider, the make and model of your device and the operating  system and version numbers of software on your device; and 

 

(k) Any other relevant application and transaction activity; and 


(l) Any other information you choose to provide to us. 


2.2 The main way g.a.s. collects personal information about you is when you provide it  to us. For example, when you: 

(a) Contact us to ask for information; 

(b) Purchase products or services from us; 

(c) Create an account in the App or use the App or Website; 

(d) Participate in customer or loyalty member promotions; 

(e) Enter a g.a.s. competition or promotion; or 

(f) Provide us with information about your opinion or submit feedback.


2.3 g.a.s. may collect personal information about you from third parties with your  consent or where otherwise permitted by law (for example, where the source of  the information is publicly available). 


2.4 g.a.s may collect personal information through the use of cookies and other automatic mechanisms. You may be given the option to reject all cookies, accept  all cookies, erase cookies stored on your device or be notified before a cookie is  stored on your device. However, if you reject or erase the cookies referred to above  some functionality or features of the App or Website may not function properly or  be fully available. 


2.5 g.a.s. may combine personal information collected through any source with other  personal information collected about you from other sources for such uses as may  be permitted in this statement. 


2.6 If you choose not to provide us with your personal information, then we may be  unable to provide you with access to some of our services and some functions and  features of the App or Website may not be available to you. 


3. How g.a.s. will use your personal information 

3.1 g.a.s. may use personal information collected for the following purposes: (a) To provide you with our products and services; 

(b) To communicate with you and/or to respond to your requests, enquiries,  complaints, and for customer care; 

(c) For marketing purposes; 

(d) To help g.a.s. to improve and develop the App and Website, including  analysing any crash or problems with the App and Website; 

(e) To enable the processing of orders and payments for goods and services  from g.a.s. by you; 

(f) To assist g.a.s. in personalising the App and Website and tailoring it to your  needs and preferences; 

(g) To verify your identity in connection with your use of the App and Website  and to conduct address or transaction verification or credit checks for billing  purposes; 

(h) To help g.a.s. to identify offers it thinks you may be interested in and to  provide such offers to you through the App; 

(i) To detect and/or prevent any illegal activity that may threaten g.a.s. or any  of our services; 

(j) Where necessary for the establishment, exercise, or defence of legal claims,  the obtaining or maintaining insurance, managing risks and/or obtaining  professional advice; 

(k) Generating information, research and insights for use by g.a.s.;  (l) For security related purposes; 

(m) For g.a.s. to comply with its legal obligations; and

(n) Such other matters as may be set out in this statement, the App, the Website, or any Terms of Use from time to time. 


4. When g.a.s. may disclose your personal information 

4.1 g.a.s. may disclose personal information collected to third parties to support us to  complete the above activities in the case of the following: 

(a) To any g.a.s. retailers or other g.a.s. related entities who may use and disclose  your information for the same purposes as g.a.s.; 

(b) To any third party whose software, applications or other services are used in  connection with the App, the Website, or otherwise for the provision of our  goods and services to you; 

(c) To any business or loyalty partner of g.a.s.; 

(d) In relation to any fuel card accepted by g.a.s., g.a.s. may provide your name,  email address and phone number to whoever holds the account for that fuel  card and provided it to you (for example, your employer); 

(e) To any person or organisation who assists g.a.s,, g.a.s. retailers, or other g.a.s. related entities in: 

(i) The provision of g.a.s.’ goods and services; 

(ii) Safety and security matters in relation to g.a.s. sites; 

(iii) Market research, advertising and customer analysis; 

(iv) Performing credit checks (such persons or organisations may share  your information with other organisations and who may keep a record  of any inquiry G.A.S makes against your name); and 

(v) Hosting or managing data, platforms and other systems for g.a.s.; 

(f) An actual or potential buyer (and its agents and advisers) in connection with  an actual or proposed purchase, merger, or acquisition of any part of g.a.s.’ business; 

(g) to regulators, law enforcement bodies, government agencies, courts or other  third parties where it is necessary to comply with any applicable law or  regulation, or to exercise, establish or defend g.a.s.’ legal rights; 

(h) where the disclosure is otherwise required by law or in order to protect your  vital interests or the vital interests of another natural person; and 

(i) As set out elsewhere in this statement. 


4.2 The third parties to whom we disclose your personal information may be located  within or outside New Zealand. Where any disclosure is to an overseas third-party  we will only make that disclosure in accordance with the requirements for overseas  transfers of personal information as set out in the applicable privacy law. 


5. Third Party Software 

5.1 The App or Website may contain or use software, applications and other services  which are created, operated and/or maintained by other providers (“Third Party 

Software”). For the avoidance of doubt, this may include other applications and  software used by your device’s operating system or installed on your device. 


5.2 Your use of the App and Website will be subject to any terms of use, including any  privacy statements or terms, that accompany or which are associated with any  Third Party Software. By using the App or Website, you agree to: 

(a) To g.a.s. using Third Party Software through and in connection with the App and Website; and 

(b) To g.a.s. disclosing your personal information to the third parties in  connection with any Third Party Software; and 

(c) To your personal information being collected through Third Party Software;  and 

(d) To adhere to any terms of use, including any privacy statements or terms that  accompany or which are associated such Third Party Software. 


6. Security 

6.1 g.a.s. will take all practicable steps to safeguard the security of your personal  information. However, g.a.s. cannot guarantee: 

(a) That your personal information will never be accessed by an unauthorised  person; or 

(b) That unauthorised disclosure will never occur. 

6.2 You acknowledge the inherent security risks of providing information over the  internet and acknowledge that g.a.s. is not responsible for any breach of security  that is outside of g.a.s.’ reasonable control. 

6.3 If you perceive that the security of the App, your account with g.a.s., or the Website is compromised, you must contact us immediately. 

6.4 You must keep all passcodes, PINs and security questions that apply to your  account in the App strictly confidential and must not allow the App to be used by  any other person.
